Estate Planning & Probate

Estate planning is the process of ensuring that the assets you’ve accumulated during your lifetime go to the people or institutions you wish in the most efficient, tax-favored, and equitable way possible.

Probate is the legal process used when someone dies.  When someone dies, whether they leave a will or not, their assets must be collected; their debts must be paid using their available assets; and the remainder of their assets, if any are left after their debts are paid, must be distributed either under the terms of their will, if they had one, or at the direction of Texas law, if they didn’t.  This process includes transferring title to all of the deceased’s real property, such as the deceased’s home, and transferring title to all of the deceased’s personal property, such as the deceased’s cars and bank accounts.   Probate is the legal process in which the court appoints the person who is authorized and required to accomplish these tasks. 

Texas has a very sleek, effective, quick, and inexpensive probate system.  The benefits of Texas probate are numerous, not the least of which is that it cuts off creditor’s claims after a specific time.  Please see the important documents below for more information.
